IN-EX E-SHOP Terms & Conditions of Sale

1. Prices
All prices quoted are F.O.B. IN-EX’s Los Angeles warehouse. Prices include carton packaging. Additional cost to be charged for all wooden crates. Prices do not include:
storage or insurance charges
sales and other local taxes
installation costs
Prices are subject to change without prior notice. All orders are subject to prices prevailing at time of Order Confirmation; unless, specifically quoted otherwise. Additions to orders already processed shall be considered as separate orders and shall be priced accordingly.
2. Terms
100% deposit is required at the time of order. No sales tax for orders shipping out of California.
Estimated production time is 4-8 weeks for all orders (unless noted otherwise). Estimated in-transit time is 6-8 weeks for all orders (unless noted otherwise). Total estimated lead time is 10-16 weeks upon order confirmation (unless noted otherwise).
3. Orders
The acceptance of the order is contingent upon written confirmation by IN-EX. Orders are subject to the terms and conditions set forth herein and on our Order Confirmation. These terms and conditions may not be modified, waived or rescinded, and in the event of any discrepancy between our terms and conditions of sale and those set forth on the Buyer’s purchase order, our terms and conditions will govern. Our Order Confirmation is final and binding.
4. Cancellation & Changes
Cancellation and changes on confirmed orders are not accepted. Payments on all orders are non-refundable. The Buyer is committed to the full amount noted on the Order Confirmation.
IN-EX reserves the right to cancel all orders. Payment(s) shall be refunded within ten working days of cancellation.
5. Shipping/Packaging
All shipments are F.O.B. IN-EX’s Los Angeles warehouse. In-Transit Time is 6-8 weeks to IN-EX’s Los Angeles warehouse, where we inspect the goods prior to arranging curbside delivery. Method of packaging is at IN-EX’s option. Special or unusual shipping, handling or set up will be subject to additional charges. Complete instructions as to shipping and route should be provided at the time the order is placed. Shipment date mentioned on this Order Confirmation, if any, is approximate only and shall not be deemed to represent a fixed or guaranteed shipment date. Shipment of the goods herein is subject to any and all delays due to any condition of happening whatsoever beyond IN-EX’s control, including but not limited to strikes, fires, wars, acts of God, inability to obtain materials, governmental regulations or restrictions. IN-EX shall not be responsible for any damage or loss resulting from delayed shipments or its inability to ship as per above to the Buyer. Shipping delays under no circumstances shall give the right to the Buyer to cancel the order.
6. Materials
The finishes and colors illustrated in our website and any subsequent communications are indicative. Variations should be considered as due to the natural characteristics of materials.
7. Claims
All goods are shipped at Buyer’s risk after they are carefully inspected, securely packed and delivered to the carrier who accepts them in good condition and agrees to deliver them to the Buyer in good condition. The Buyer should, before accepting the merchandise from the carrier, inspect the goods and note any loss or damage on the delivery receipt. Claims of damages or shortages after such acceptance will not be accepted.
8. Returns
Return of goods will not be accepted without a written authorization and shipping instructions by IN-EX. All authorized returned goods to be delivered back to IN-EX warehouse in perfect condition. Unauthorized returns will not be accepted and will be returned freight collect. Authorized returns are subject to a restocking fee of 40%. Authorized returns must be made freight prepaid within (10) days of the delivery date .
9. Design
The products shown in our website and contained in any communications are and to remain the property of IN-EX. All dimensions and weights shown are to be considered approximate. IN-EX reserves the right to make changes in dimensions, details of designs, finish and construction without prior notice.
10. Storage
If the Buyer does not accept delivery of merchandise ready for shipment, IN-EX may transfer the merchandise to a storage facility. Transfer to and from storage, insurance and all the pertaining storage costs will be at the Buyer’s expense. Buyer bears the risk of loss or damage during storage.
